Stryker and Indie have a very complimentary pedigree, filled with Gaff and Larum dogs.  We are hoping Stryker will improve rear and in turn, back/topline, while Indie will in turn bring her gorgeous headpiece, tight feet, spitfire attitude, and pigment. 


Puppies will be evaluated at 8 weeks, and then the picking process will begin!  $500 deposit reserves your pick. 


If you are interested in owning one of these pups, please use the contact form at the bottom of the page.  Preference will go to show and/or performance homes.  Deposits due when puppies are 6 weeks of age, to ensure your picking order.  It is very important to me to send the right puppy to the right home.  I want happy owners, and most importantly, happy puppies!  Therefore, I reserve the right to choose your puppy for you if you are not planning on showing/competing with the puppy.  I will ALWAYS take a puppy or dog back at any point in its' life, should the owner become unable to properly care for him/her.

Whereas, the following agreement is made between Jayna Marshall, of h2o American Pit Bull Terriers, ("Breeder") and ____________________________, ("Buyer") for the sale and purchase of one purebred dog of the American Pit Bull Terrier breed, referred to hereinafter as the “Dog,” and more fully described below as:

Whereas, the Breeder is amenable to selling the Dog to the Buyer, for good and valuable consideration, the sufficiency of which is mutually acknowledged by both parties, pursuant to the following terms:

 

1.1.                  PURCHASE PRICE.   Purchase price of $_________ (the “Purchase Price”) paid by the Buyer to the Breeder.  A non-refundable deposit of $________  has been made and the Dog will be held until the Dog is 10 weeks of age(11/20/16).  On or before that time, the balance of the Purchase Price must be paid in full or the deposit is forfeited and Breeder shall make alternate arrangements for the placement of the Dog to an alternate party.  Communication is key!

 

1.2                   TRANSPORTATION COSTS.  All transportation costs will be paid by the Buyer.  Transportation costs, including the shipping container, airport delivery charge, and any expenses involved in the shipping of the Dog are the responsibility of the Buyer. Under no circumstances shall the puppy be transferred prior to 8 weeks of age.

 

1.3                   HEALTH AND HEALTH GUARANTEE.  It is the buyer’s responsibility to have the dog examined by a licensed vet within 7 days of receipt. An initial wellness exam is important for the proper care and Veterinary relationship for the puppy.  If the dog is considered to have any genetic illness or genetic disease by 2 or more vets that warrants euthanasia before the puppy turns 2 years of age, a full refund, excluding shipping, will be given to the buyer via money or another puppy/dog (at discretion of the breeder). After 7 days, if the puppy has not had an initial examination by a licensed vet, guarantee is void and the condition of the APBT is solely the buyer’s responsibility.  h2o American Pit Bull Terriers is not responsible for health problems in regards to proper vaccinations, veterinary care, feeding, socialization, overall care,  and due to the natural aging process.

 

The puppy shall have been given proper deworming, vaccinations, and heartworm/flea prevention for the age of the puppy.  The buyer shall receive a list of all deworming, vaccinations and heartworm/flea medication along with the dates given and dates when due for next sets.  A list of all parent health clearances will be given to the buyer at the time puppy goes home.

 

1.4       REGISTRATION.  The APBT’s registered name is to include h2o’s in the beginning of the registered name on the official papers from UKC/ADBA, or any other registry, for the life of the dog, and is not to be deleted or changed. The registered name beyond that is the buyer’s choice, in line with the theme of the litter, which is PATRIOTISM.

 

1.5       OWNERSHIP RESPONSIBILITIES.   The Buyer agrees to maintain the Dog in a humane environment and properly train and care for it. Specifically, the Dog will be properly licensed and inoculated against rabies, distemper, parvovirus, and other communicable diseases as recommended by a qualified veterinarian. The Dog will not be allowed to roam and will be socialized and obedience trained appropriately.  The Dog must be fed a wholesome and nutritious diet throughout its life to ensure health and longevity.  h2oAPBTs feeds and recommends VICTOR brand dog food, but the buyer is not limited in what they may feed.   If puppy/dog is fed a raw diet, buyer must research a proper and balanced raw diet.

 

*THE FOLLOWING PARAGRAPH IS ONLY APPLICABLE TO SHOW POTENTIAL PUPPIES: In the event the buyer chooses to breed this APBT, official documentation of required health testing must be given to breeder.  These health tests are as follows: Hips, Elbows, Heart, and Patellas.  This APBT should also have a minimum of a UKC Conformation Champion title/degree, as well as a working/performance title, and be over the age of 24 months old prior to being bred.  This Dog may only be bred to another UKC registered American Pit Bull Terrier, and is not to be used to outcross to any other breed, such as an American Bully.*

 

*THE FOLLOWING PARAGRAPH IS APPLICABLE ONLY TO CO OWNED PUPPIES: In order to complete the Co-own agreement, dog must obtain their UKC Conformation Champion title, one performance title, and all health testing outlined in paragraph above.  Dog must be bred to an APBT both buyer and seller agree most closely matches the UKC APBT standard, and complements the aforementioned dog.  Seller (h2o APBTs) will receive one puppy back from the breeding, second choice after Buyer.  When second pick puppy is received by Seller, all UKC paperwork on co-owned dog will be signed over to Buyer.  COMMUNICATION IS KEY IN THIS AGREEMENT. Seller (h2o APBTs) will pay for any shipping costs incurred in the delivery of the puppy.*

 

The Buyer stipulates and agrees to ensure that the Breeder has the Buyer’s current address, telephone number and email address at all times throughout the life of the Dog.  Buyer must also update Breeder with photos at least annually, so Breeder may have a visual record of how the lines mature and age.

 

1.6       SPAYING AND NEUTERING. (PET PUPPIES)  Puppies which are purchased as family companions and dogs which are judged not to be of show and breeding quality shall be spayed or neutered by the time they are 24 months of age.  Breeder recommends leaving females intact until at least 1 year, and males intact for the full 24 months, if the dog can successfully be prevented from breeding. Breeder shall remain Sole Signatory on Pet Quality puppies until proof of spay/neuter has been provided.   

 

1.7       SHOW POTENTIAL PUPPIES.  The Breeder will use her best judgment and the advice of other fanciers in evaluating the puppies as to show or pet quality. There is no guarantee that a puppy evaluated as "Show Potential" will be successful in the show ring as an adult or have success as a breeding animal, and no warranties are made to that effect.

 

Buyer agrees that if the Dog is shown and becomes a Champion, a picture along with a copy of Championship certificate will be sent to the Breeder.  A copy of each title/degree obtained in any sport/registry shall be emailed to Breeder, or Breeder shall be tagged in photo of title/degree on a Social Media site, such as Facebook or Instagram.

 

1.8       RIGHT OF RECOVERY.  If, for whatever reason, the Buyer cannot or does not wish to maintain custody of the dog (at any time during its lifetime) the Buyer must return the Dog to the Breeder at the Buyer’s sole expense. Buyer shall not sell or place the Dog with another home without written consent from the Breeder. The Breeder will always accept the Dog back for any reason, or no reason, whatsoever. The Buyer shall not be entitled to any refund on the Purchase Price or Transportation if the Dog is returned to the Breeder. The Breeder wishes to make sure that the Dog is well cared for and placed in a proper environment for its entire lifespan.   Buyer may not under any circumstances place the Dog in a humane society, pound, or other animal control facility. 

 

1.9       LIMITATIONS OF CONTRACT.  This contract applies to the Dog only and is non-transferable to a second party.

 

2.0       UNDERSTANDING THE TERMS OF THE CONTRACT.  Buyer stipulates and agrees that he/she has read and understands the terms and conditions of this contract fully. This contract is formed under the jurisdiction of the State of Delaware, County of Kent.  The parties stipulate and agree that Kent County, Delaware shall have exclusive jurisdiction and venue over any action arising out of the Agreement.

 

2.1       BREACH OF CONTRACT.  Great effort and thoughtful consideration has preceded the breeding, sale, and purchase of this APBT.  Buyer agrees to abide by this contract.  Violations of this contract reflect negatively on the good reputation of the Breeder and are detrimental to the APBT breed.  It is stipulated by and between the parties herein that failure to comply with the conditions of this contract shall constitute a “breach of contract”, and shall result in the dog being permanently returned to the Breeder.  Buyer shall forfeit all monies paid on the dog and the Buyer shall sign over to Breeder the UKC/ADBA registration on the dog.  If the dog is returned to Breeder because of breach of contract, it shall be at no expense to the Breeder.  

 

2.2       This Purchase and Sales Agreement (the “Agreement”) represents the entire agreement between the parties.  

 

 

This contract is designed to protect the Dog and its future offspring, the Breeder and the Buyer of said Dog. By signing, all parties agree to all clauses of this contract.
